Basic Requirements to Qualify for Chapter 7 Bankruptcy

    There are many variables to look at when determining whether you can file Chapter 7 bankruptcy. However, to qualify for Chapter 7 bankruptcy in California, in most cases, you must meet the following basic requirements:

    1. Means Test: You must pass the means test, which compares your household income to the median income for a household of similar size in California. If your income is below the median, you can file for Chapter 7 bankruptcy.
    2. Residency: You must have lived in California for at least 91 days prior to filing for bankruptcy.
    3. Previous bankruptcy: You must wait the required amount of time before filing a Chapter 7 bankruptcy if you received a discharge in a previous bankruptcy case.

    Additionally, you must complete a credit counseling course before filing for bankruptcy, and provide financial information, including a list of assets and liabilities, to the court.
